Garden waste terms and conditions

This agreement is made between the customer (you) and the London Borough of Hammersmith & Fulham (us) and sets out the terms and conditions of the chargeable garden waste service.

Payment

  1. The garden waste service costs £90 per annum and the subscription period commences from the date of your first garden waste collection day.
  2. You can either pay online when you subscribe or over the phone by calling 020 8753 1100
  3. The service is an annual service, and a payment must be made every year for the service to remain in place.
  4. Where we have valid contact information, a reminder will be sent to you approaching the subscription anniversary to remind you to resubscribe. However, it is your responsibility to ensure that the subscription is renewed. 
  5. Automatic renewal is not in place, there is no option to pay by direct debit and we do not store your payment details. To renew your subscription, you will need to contact us using one of the methods in 2 above.
  6. The annual payment made by you is for the supply of the garden waste service and not for the sacks. However, the annual payment means that we will provide 2 x 90 litre sacks per subscription for you to store and present your garden waste in. The sacks remain the property of the London Borough of Hammersmith & Fulham.
  7. Where you renew your subscription, we will assume that you already have the two sacks per subscription and new sacks will not automatically be offered to you.

Sack contents

  1. The following materials may be presented in your garden waste sacks:
    -    leaves and prunings, 
    -    twigs and small branches, 
    -    weeds, 
    -    old plants and flowers (no soil), 
    -    small quantities of fruit
  2. The following materials may not be presented in your garden waste sacks:
    -    food waste, 
    -    soil, 
    -    rocks and stones, 
    -    plant pots, trays, or plastic bags, 
    -    large trunks, 
    -    large branches and logs.
  3. If on arrival it is deemed that your property does not meet the requirements of an eligible property (Health and Safety Issues or other issues which mean that it is not practicable to provide a garden waste service in relation to that property) the sacks(s) will not be delivered. In this instance you will not be entitled to the Service but will receive a refund.

Containers

  1. The payment of £90 per year means that we agree to provide you with the containers for the exclusive use of the garden waste service. The containers that will be provided will be two 90 litre polywoven sacks.
  2. If you require us to provide you with any additional sacks you will be charged £90 for an additional garden waste subscription.
  3. You will be able to sign up for a maximum of four subscriptions (eight sacks). 
  4. You can only request the same number of sacks that match the number of garden waste subscriptions that you have signed up for.
  5. If you are renewing your existing service and want to sign up for an additional service, you will only be provided with sacks for the additional service.
  6. We reserve the right to remove any containers which are not being used as part of a valid paid for Garden Waste subscription service.
  7. Any sack that has been lost or damaged will be replaced. You can order a replacement sack by phoning 0208 753 1100.
  8. If you find your missing sack(s) after we have delivered a replacement, please let us know by contacting 0208 753 1100.
  9. We will not collect from more than two sacks unless you have paid for more than one garden waste service.
  10. The council reserves the right to alter the sizes of the collection containers at any time.
  11. Whilst you maintain your subscription services, the sacks are loaned to you, and therefore you are responsible for maintaining them in a serviceable condition, their cleanliness, and the cleanliness around the sack’s location whilst in your possession. If you wish to put your house number or name on the sack it must be done in such a way that if required, the sack can be restored to its original condition.
  12. You are responsible for keeping the sacks safe and secure. In the event of the sack being lost, stolen, or damaged you may be required to pay to the Council the costs of an equivalent replacement sack and its delivery unless the Council has lost or damaged the sack(s) during collection.

Collection frequency

  1. Collections will take place weekly on a specified collection day. However, there will be no collection service for a three-week period from 25th December to 15th January each year.
  2. Garden waste collections will continue to be on the same collection day unless the council inform you otherwise. However, the council reserves the right to alter collections if required and will endeavour to provide adequate notice to all householders that would be affected by the alteration.
  3. The council (via the Contractor) will make every effort to carry out collections on your collection day between 6am and 4pm. However, there may be delays due to events outside of the council’s control.

Presentation of sacks

  1. Garden waste sacks must be presented for collection by the resident as near to the pavement as possible by 6.30 am on the day of collection. The sacks must still be within your property boundary and not placed on the pavement. If your garden waste sacks are not presented as near to the pavement as possible, we reserve the right not to collect your sacks.
  2. Your sacks must be presented so that as far as possible they are visible from the road.
  3. The sack lid must be fully closed otherwise the contractor may refuse to empty the sack.
  4. If you report a missed collection, but your container has not been correctly presented, we will not return to empty your container. You will need to wait until your next collection day for your container to be emptied.
  5. The Contractor will not collect garden waste contained in any other container(s).
  6. All garden waste should be presented loose inside the sacks. 
  7. You grant the council the right (and the Contractor when authorised by the council) to enter into or upon the premises to remove the sacks in the event of withdrawal of the service or contamination of the material.
  8. No excess or “side” garden waste will be collected.
  9. Residents that already receive an assisted collection service for waste and recycling collections will be eligible for an assisted collection for their garden waste.
  10. Once garden waste has been collected from the household it is the property of the council. It will be sent to a reprocessing facility.

Missed collections/non collection of garden waste sacks

  1. If incorrect materials are placed into your sacks, the council reserves the right not to empty your sacks until you have removed the incorrect materials or items. Once the incorrect materials have been removed, your sacks will be cleared on the next scheduled collection day.
  2. A contamination tag may be left on your sacks advising you of the materials that can and cannot be placed in your garden waste container. You are required to remove any incorrect materials in the garden waste bin before the next collection.
  3. If we do not collect your garden waste sacks, you have two working days to report a missed collection to us, either online H&F Report It - Login (mediaklik.com) or by calling 020 8753 1100.
  4. We will not return to empty a missed collection if you do not report it to us within two working days of your normal collection day.
  5. No refunds will be provided for non-collection of your garden waste for any reason.

Changing address

  1. If you move property within the borough of Hammersmith & Fulham, your garden waste service will be transferred to your new property. You must let us know that you have changed address within five working days of moving to your new property.
  2. You will be responsible for moving your garden waste sacks from your old property to your new address within Hammersmith & Fulham.
  3. If you move to a property outside Hammersmith & Fulham, please let us know so that we can cancel the garden waste service. You will not be entitled to a refund and will be required to return the garden waste sacks.
